This guide translates the proposed purchase contract into plain English so you can review exactly what you would be agreeing to before we send it for your signature. 1 How the Money Works
Here is how the money flows from you to the seller.
The math: $525,000 purchase price − $101,000 down payment = $424,000 loan amount. Per your pre-qualification, principal and interest come to approximately $2,714.92 per month, with total monthly housing cost not to exceed $3,342.14.
No PMI advantage: Because your down payment exceeds 20%, you will not be required to carry private mortgage insurance (PMI), which saves you roughly $150–$250 per month compared to a 10% down payment.
Includes: all fixtures, built-in appliances, ceiling fans, garage door openers, light fixtures, window coverings, landscaping, in-ground pool/spa equipment, security systems, water softener, water purification, smart home devices, and storage sheds. Leased items are excluded; the seller will notify you of any leased items within 3 days of acceptance.
2 Earnest Money
Your earnest money is a good faith deposit that shows the seller you are serious. It will be applied toward your purchase price at closing.
Protected when you: cancel during the inspection period, cannot get loan approval, the appraisal comes in low, title issues arise, or the seller breaches the contract.
At risk when: you walk away after all contingencies have expired without a valid contractual reason.
3 Title & Escrow
The escrow company holds all money and documents, verifies clean title, handles paperwork, and records the deed. Title insurance protects you against problems with property ownership that might surface after closing.
4 What the Seller Disclosed (SPDS)
The seller (WHITE FIG HOMES JV LLC) is required to deliver a completed Seller's Property Disclosure Statement (SPDS) within 3 days after contract acceptance. The SPDS was not included in the documents provided for this guide.
Note: The seller is an LLC (WHITE FIG HOMES JV LLC), not an individual owner-occupant. This means the seller may have limited firsthand knowledge of the property's history. Your inspections will be especially important.
6 Inspections
You have 10 days from contract acceptance to complete all inspections. During this period, hire qualified inspectors to evaluate:
- General home inspection
- Pest/termite (wood-destroying organisms)
- Roof condition
- HVAC systems
- Plumbing and electrical
- Pool and spa
- Sewer scope
- Square footage verification
- Insurance availability and cost
If problems are found, you have two options:
- Cancel the contract and get your earnest money back, OR
- Submit a BINSR (Buyer's Inspection Notice and Seller's Response) listing what you want addressed. The seller then has 5 days to respond: they can agree, counter, or refuse. If the seller refuses, you get 5 more days to either cancel or accept the property as is.
All agreed repairs must be completed 3 days before closing with paid receipts provided to you.
Final walkthrough: You will walk through the property before closing to confirm it is in substantially the same condition as when you made your offer and that any agreed repairs have been completed.
The property is connected to a public sewer system.
7 Warranties & Protections
"As is" means the seller is not promising the property is perfect. However, the seller must maintain the property in its current condition until closing and must disclose all known material defects.
Appraisal contingency: The property must appraise at $525,000 or more. If the appraisal comes in low, you have 5 days to cancel and get your earnest money back.
Cure period: If either side fails to perform, the other party sends a written notice and gives 3 days to fix the problem before it becomes a breach.
Disputes: Mediation first, then binding arbitration. The losing party pays the prevailing party's legal fees.
